Trademark notarization process
Trademark transfer needs to go through the formalities in the Trademark Office, and its process includes: applying for accepting the review announcement and issuing the transfer certificate. The seller and the buyer sign a trademark transfer contract/agreement. Trademark notarization is generally completed within 3-5 working days after the trademark holder obtains the Trademark Declaration Notary Certificate. Submit the prepared materials and notarial certificate to the Trademark Office, and then pay the transfer fee (generally 1000 yuan). The Trademark Office issued an acceptance letter in about 1-2 months and began to review. The Trademark Office will issue an announcement about 5-8 months after accepting the application, and issue a certificate of approval and transfer of the registered trademark to both parties. Required materials, trademark/registered trademark transfer application (signed or sealed by both parties). Trademark transfer agreement or contract signed by the transferor and the transferee. Identification documents of the transferor and the transferee (if it is a legal person, a license is required). Certificate of registered trademark and notarial certificate of trademark declaration of notary office (required by Trademark Office). Please provide the original and photocopy of the agent's identity certificate for agency operation. If the application documents are in a foreign language, a Chinese translation signed and confirmed by the translation agency shall also be provided. Note: 1. After the transfer of the trademark is completed, the transferee shall enjoy the exclusive right to use the trademark from the date of announcement. If the original trademark registrant continues to use the trademark for goods without permission, it is illegal. 2. Not every trademark transfer requires a notarial certificate, but depends on the requirements of the Trademark Office. Generally speaking, however, if the value of the transferred trademark is large, or there is any doubt during the examination, the Trademark Office will generally require a notarial certificate. At this time, it is necessary to transfer the transferee to the notary office for notarization. Trademark notarization needs to prepare the following materials to the notary office: a copy of the transferee's ID card or business license; If the transferor or transferee is an enterprise legal person, the original and photocopy of the ID card of the legal representative shall be provided; If the transferor or transferee is an enterprise legal person, provide the articles of association and the original resolution of the shareholders' meeting agreeing to transfer or transfer the trademark; Original and photocopy of the transferor's registered trademark certificate, trademark ownership certificate and trademark pattern 1 copy; The written consent certificate of all * * * owners is required for some trademarks owned by many people; If a third party has been licensed to use the registered trademark, a written certificate of the licensee's consent to the transfer shall be submitted.
