The Trademark Office and the Trademark Review and Adjudication Board have slightly different criteria for judging whether a trademark is similar: the Trademark Office basically conducts a review according to the review criteria, while the Trademark Review and Adjudication Board will comprehensively consider various factors. 3. Trademark examination is subjective, and different examiners may get completely different results. Based on the subjectivity of trademark examination, a trademark rejection examination can be filed. Of course, the above is general, specific to each case will be different. However, there is a view that must be wrong, that is, if a trademark is rejected, it must not be applied, or there is no chance of success in filing a case for review. Of course, if the trademark is rejected because there is a prior identical trademark, or the Chinese and English parts are exactly the same as the prior trademark, then it is useless to file a reexamination. Therefore, we can't generally say that the rejected retrial application will definitely pass or the rejected application will definitely have no chance to pass.
