Company trademarks can be transferred to individuals. According to Article 42 of the Trademark Law, if a registered trademark is assigned, the assignor and the assignee shall sign an assignment agreement, and both parties shall apply to the Trademark Office. The transferee shall guarantee the quality of the goods using the registered trademark. Where a registered trademark is transferred, the trademark registrant shall transfer the similar trademark registered on the same commodity or the same or similar trademark registered on similar commodities together. The Trademark Office shall not approve trademarks that are likely to cause confusion or other adverse effects, and shall notify the applicant in writing and explain the reasons. After the transfer of a registered trademark is approved, it shall be announced. The transferee shall enjoy the exclusive right to use the trademark from the date of announcement. Article 31 of the Regulations for the Implementation of the Trademark Law of People's Republic of China (PRC), where a registered trademark is transferred, the transferor and transferee shall submit an Application for Transfer of a Registered Trademark to the Trademark Office. The application procedures for the assignment of a registered trademark shall be handled by both the assignor and the assignee. Where the Trademark Office approves an application for the transfer of a registered trademark, it shall issue a corresponding certificate to the transferee and make an announcement. Where a registered trademark is transferred, if the trademark registrant fails to transfer the same or similar trademarks registered on the same or similar goods together, the Trademark Office shall notify him to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be deemed as giving up the application for transferring the registered trademark, and the Trademark Office shall notify the applicant in writing.
