Trademark and trademark ownership
We know that in the era of intellectual property rights, the importance of trademarks increases the number of trademark registrations. Because the difficulty and cycle of trademark registration are not conducive to the normal development of enterprises, when obtaining the corresponding trademarks, we usually choose to transfer to obtain the corresponding trademarks. We also know that trademark transfer is actually the transfer of trademark rights. Do we need to transfer all trademark rights during trademark transfer?

When we transfer a trademark, we mainly transfer the ownership of the trademark. In the process of trademark transfer, if there is a similar trademark, but it is not transferred together, the original trademark owner shall enjoy the trademark right of the similar trademark. Trademark transfer shall be decided by both parties through consultation. The transferor can only transfer the right to use, not the ownership. Article 42 of the Trademark Law of People's Republic of China (PRC) assigns a registered trademark. The assignor and the assignee shall sign an assignment agreement and file an application with the Trademark Office. The transferee shall guarantee the quality of the goods using the registered trademark.

Where a registered trademark is transferred, the trademark registrant shall transfer the similar trademark registered on the same commodity or the same or similar trademark registered on the same commodity together. The Trademark Office shall not approve the assignment that may cause confusion or other adverse effects. It shall notify the applicant in writing and explain the reasons. After the transfer of a registered trademark is approved, it shall be announced. The transferee shall enjoy the exclusive right to use the trademark from the date of announcement.

To sum up, in the process of trademark transfer, we need to transfer all similar trademarks together to ensure the normal operation of future business activities.
