There is no crime of counterfeiting trademarks in the criminal law. Counterfeiting trademarks is classified as the crime of counterfeiting registered trademarks. If the defendant is detained, the sentence will usually be pronounced within two months after the court accepts the case, and no more than three months at the latest. If the defendant is not in custody, the verdict shall be pronounced within six months after the case is accepted.

Article 212 of the Criminal Procedure Law of the People's Republic of China

The People's Court may conduct private prosecution cases Mediation; before the judgment is announced, the private prosecutor may reconcile with the defendant or withdraw the private prosecution. Mediation is not applicable to cases specified in Paragraph 3 of Article 210 of this Law.
