Civil liability
refers to the civil legal consequences that an infringer should bear for committing an infringement.
1. Copyright infringements subject to civil liability. First, infringement causes damage to the legitimate rights and interests of others. The fact of damage is the prerequisite for tort liability. Second, there is a causal relationship between the actor's behavior and the fact of damage, and the actor's behavior causes or facilitates the occurrence of the fact of damage. Third, the perpetrator committed the infringement due to fault. Fourth, the perpetrator must have civil capacity.
2. Form of civil liability
(1) Stop the infringement. In order to stop the infringement in a timely manner and prevent the damage from expanding, the victim may request the people's court to order the infringer to immediately stop the ongoing infringement. For example, at the request of the injured person, the people's court can order a publishing house that publishes infringing books to immediately stop publishing and distribute the infringing books, and the published books should be recovered, sealed, and destroyed.
