All producers in this field should have the right to indicate the origin of their goods and should not be used exclusively by one producer. "At the same time, place names can also be registered as trademarks under certain conditions. However, based on the descriptive characteristics of place names, the holders of registered trademarks of place names should be restricted in exercising the exclusive right to use registered trademarks, that is, they should not use the exclusive right to use registered trademarks to oppose others' legitimate use of the same place names as the trademarks. This is the embodiment of the principle of fair use of law specially created to balance the contradiction between the trademark exclusive right of the trademark owner and the right of others to use public words. The "proper use" of a place name refers to the use of the place name within the meaning range indicating its geographical origin. For example, as early as 1988, the State Trademark Office pointed out that Tangshan was the name of an administrative division and did not have the distinctiveness that a trademark should have. Due to historical reasons, the word "Tangshan" has been registered as a trademark and should be protected within its validity period. But this should not prevent Tangshan enterprises from using the word "Tangshan" as the name of the place of origin. If the word "Tangshan" is used as the name of the place of origin, it does not constitute trademark infringement.
