On the characteristics of Hong Kong’s lawyer system
Hong Kong's lawyer system originated from the British lawyer system, and its biggest feature is that there are two branches of the legal profession: barristers and solicitors. There are many differences between barristers and solicitors in terms of scope of practice, qualification requirements and practice methods. In terms of business scope, solicitors are only allowed to handle litigation cases and non-litigation matters under the jurisdiction of local courts and courts below. Barristers appear in court as defenders, but they cannot have direct contact with the parties. To accept the client's case entrustment, they must be hired by a solicitor. That is, the litigant must first hire a solicitor, and the solicitor will hire a barrister on his behalf. In terms of qualifications, solicitors who apply for barrister qualifications should have obtained solicitor qualifications in Hong Kong at least three years before the time of application. Those who are employed as solicitors from barristers should at least obtain barrister qualifications in Hong Kong, the United Kingdom and Northern Ireland and have practiced law for more than five years. For overseas persons or overseas lawyers to apply for Hong Kong solicitor qualifications and practicing certificates, in addition to meeting certain academic qualifications, experience, character and other conditions, they must also pass the "Overseas Lawyers Qualification Examination" established by the Hong Kong Law Society. In terms of business practice, solicitors can practice alone or in partnership. A barrister can only register in his own name alone or work together with other barristers. The practice organization of a solicitor is called a law firm, and the practice organization of a barrister is called a barrister's office or barrister's office. At the same time, Hong Kong lawyers are divided into practicing lawyers, government lawyers and corporate lawyers, senior barristers and ordinary barristers, notary solicitors and ordinary solicitors. In addition, Hong Kong lawyers are legally "personnel" of the High Court and are subject to the supervision of the court. They are candidates for Hong Kong judges, but they are outside the court management system. The diversity and complexity of Hong Kong's lawyer system reflects the extensive demand for legal services in Hong Kong society, and also illustrates the positive role Hong Kong lawyers play in social and economic life.
