In order to implement the spirit of Document No.1 of the Central Committee and the Provincial Party Committee, support, promote and guide the healthy development of family farms, and standardize the registration of family farms in our province, these measures are formulated in accordance with the Regulations on Individual Industrial and Commercial Households, the Law on Sole proprietorship Enterprises, the Law on Partnership Enterprises, the Law on Farmers' Specialized Cooperatives, the Company Law and relevant registration laws and regulations.
Article 1. Families or family members as the main investors and operators who engage in moderately large-scale, intensive and commercialized production and operation of agriculture, forestry, animal husbandry and fishery by operating land, forest land, mountains and waters contracted by others may be registered as family farms according to law.
A family farm applying for registration according to law shall meet the following conditions:
1, family farm operators should have rural household registration;
2. Family members are the main labor force;
3. Agricultural income is the main source of family income;
4. The scale of operation is relatively stable, and the land is relatively concentrated and contiguous. The lease period or contract period of land should be more than 5 years, and the scale of land operation should meet the requirements of planting and breeding stipulated by the local agricultural department.
Article 2 Applicants for family farm registration voluntarily choose the registration form and organization form. Family farms can be registered as individual industrial and commercial households and sole proprietorship enterprises. Those who meet the requirements stipulated by laws and regulations may also apply for registration as partnership enterprises, companies and other organizational forms.
Family farms can become unit members or company shareholders of farmers' professional cooperatives after industrial and commercial registration. If there are more than 5 family members in rural areas, you can register as a natural person as a "family farm professional cooperative".
If the transformation and upgrading of family farms are registered in the form of companies and other organizations, the original brand name and industry terminology can be retained; If there are laws and regulations in the original business project that require permission to operate, it can continue to operate after being confirmed by the issuing authority.
The registration authority shall strengthen the publicity and guidance on the relevant laws and regulations of the family farm operators who apply for it, so as to facilitate them to choose the organizational forms that are beneficial to their operation and benefit the people.
Article 3 A family farm shall be registered by the county where its business place or domicile is located, the city administration for industry and commerce without districts and its branches, except as otherwise provided by laws and regulations.
The registration authority may entrust qualified industrial and commercial enterprises to register family farms in the name of the registration authority. The authorization authority and subject type shall be reported to the Municipal Administration for Industry and Commerce for the record.
Article 4 The name of a family farm consists of administrative division, shop name and family farm in turn. Family farms can be used together with farmers' professional cooperatives, companies and other organizational forms, but their applicable industries and organizational forms should comply with the provisions of the laws and regulations on which they are based.
Support family farms to use the name and trademark of the operator as the font size, or apply for trademark registration with the font size.
Article 5 The business place (domicile) of a family farm may be the home address of the operator or the village site where the planting and breeding place is located.
Article 6 Family farms can engage in related research and development, processing, sales or services on the basis of agriculture, forestry, animal husbandry, fishing and aquaculture.
If a family farm applies for a general business project, the business scope can be approved as a family farm operation, or it can be approved according to the specific project according to the application. Where pre-licensing is involved, relevant licensing procedures are required before business activities can be carried out.
Article 7 Applicants for family farms may make contributions in various forms, such as currency, physical objects, land contractual management rights, intellectual property rights, stock rights, technology, etc. Individual industrial and commercial households, sole proprietorship enterprises, partnerships and farmers' professional cooperatives organize family farms, and their contributions are declared by individuals themselves. Other forms of organizations shall abide by the laws and regulations on which their registration is based.
Article 8 To apply for registration of the establishment of a family farm, the following registration materials shall be submitted:
1. Application for establishment registration;
2. The identity certificate of the applicant;
3, "rural land contractual management right certificate", "forest right certificate", "rural land contractual management right transfer contract" and other business land and forest land certificates;
If there are items in the business scope that must be approved before registration according to laws and regulations, a copy of the relevant license certificate or approval document shall be submitted; Before getting approval, you can go through the preparatory registration first.
If an agent is entrusted, the certificate of entrusted agent signed by the operator and a copy of the ID card of entrusted agent shall also be submitted.
The establishment registration of family farms registered in the form of partnership enterprises, farmers' professional cooperatives and companies shall be carried out in accordance with the materials submitted by the State Administration for Industry and Commerce.
Article 9 Where the statutory registration items of a family farm change, it shall apply for registration of change in accordance with relevant laws and regulations.
Article 10 If a family farm is no longer engaged in business activities, it shall cancel its registration with the registration authority according to law.
Article 11 The registration authority shall supervise and manage the registered family farms according to law. The registration authority shall strengthen the administrative guidance, urge the family farm to standardize its operation, and deal with its illegal acts according to the corresponding laws and regulations.
Twelfth copies of the family farm business license shall be valid in accordance with the land contract or the transfer period.
Thirteenth family farms are exempt from registration fees, annual inspection fees and production fees.

Fifteenth operators engaged in family farms shall, within 30 days after obtaining the business license, file with the agricultural and other departments in the place of registration.
Article 16 These Measures shall come into force on May 6, 2065 and shall be valid until May 5, 2065. After the State Administration for Industry and Commerce and the provincial government issued new measures for the registration of family farms, these measures shall be abolished by themselves.
