Firefly energy-saving lamp trademark dispute case Firefly Europe suffered from squatting

Donglin Company is a well-known energy-saving lamp company in Xiamen. Its original brand Firefly, which has been carefully cultivated for 8 years, has been rated as one of the top ten well-known brands in China's lighting industry and a famous best-selling brand in China, and has flown to 22 countries including Poland and the Philippines.

In May 2004, the headquarters of Donglin Company received a report from a Polish dealer saying that they were rejected when promoting Firefly energy-saving lamps in the German market. Bad news followed. Firefly was rejected by Germany, the United Kingdom, France, Spain and other countries for the same reason, that is, the brand had been registered in these countries.

Donglin Company immediately conducted an inquiry, and the result was shocking. It turned out that Siemens and Osram had taken the lead and registered the Firefly brand in 18 European countries.

Siemens and Osram are Donglin’s old rivals in the anti-dumping war. As a major energy-saving lamp manufacturer in Europe, as early as May 2000, Siemens and Osram filed an anti-dumping lawsuit against the European Union against China's energy-saving lamp industry. Among the 20 listed Chinese energy-saving lamp manufacturers is Donglin Company. In June 2001, the European Union made a final anti-dumping ruling, and China's energy-saving lamp products were imposed a high anti-dumping tariff of 66.1%.

In October 2002, Siemens and Osram filed for review on the grounds that the EU ruling failed to protect similar companies in the EU and requested an increase in the amount of anti-dumping duties. Among the 10 listed Chinese energy-saving lamp manufacturers, Donglin Electronics is once again among them. At that time, only one of the 10 Chinese companies, Donglin Company, actively responded to the lawsuit. As a result, Donglin Company became the first private enterprise in China to respond to foreign anti-dumping investigations. It was described by the media as a firefly fighting alone. In October 2003, Siemens and Osram unconditionally withdrew the lawsuit.

After discovering that the Firefly trademark had been preemptively registered, Jia Qiang immediately flew to Germany to conduct market research. As a result, no Siemens and Osram energy-saving lamp products under the Firefly brand were seen in all famous shopping malls in Germany. At the same time, he noticed The time when Siemens and Osram applied to register the Firefly trademark in Germany coincided with the EU's final decision to impose high anti-dumping duties on Chinese energy-saving lamp products. Based on this, it is judged that this is likely to be malicious registration.
