The new Trademark Law stipulates: Article 44 If a registered trademark violates the provisions of Articles 10, 11 and 12 of this Law, or is registered by deception or other improper means, the Trademark Office shall declare the registered trademark invalid; Other units or individuals may request the Trademark Review and Adjudication Board to declare the registered trademark invalid.

Since a trademark has been declared invalid, it shall be filed by the Trademark Office or other units and individuals and handled by the original trademark owner. If there is no problem with the final trademark, it can continue to be transferred; If a trademark is declared invalid, the trademark transfer or license contract that has been performed shall not be retroactive, and the trademark transfer fee must be returned.
