According to the provisions of the Interpretation of the Supreme People's Court on Jurisdiction and Scope of Law in the Trial of Trademark Cases, the court accepts the following trademark cases: cases that refuse to accept the reexamination decision or ruling made by the Trademark Review and Adjudication Board of the the State Council Administration for Industry and Commerce; A case that refuses to accept a specific administrative act on trademarks made by the administrative department for industry and commerce; Disputes over the ownership of trademark exclusive rights; Disputes over infringement of the exclusive right to use trademarks; Disputes over the transfer contract of the exclusive right to use a trademark; Disputes over trademark licensing contracts; Apply for stopping the infringement of trademark exclusive right before litigation; Application for pre-litigation property preservation cases; Apply for pre-litigation evidence preservation cases; Other trademark cases.

II. Who is under the jurisdiction of trademark cases

For cases of first instance that refuse to accept the reexamination decision or ruling made by the Trademark Review and Adjudication Board of the State Council Administration for Industry and Commerce, the Beijing Higher People's Court shall determine the jurisdiction of the relevant intermediate people's courts within its jurisdiction according to the authorization of the Supreme People's Court.
