(1) During the grace period of a registered trademark, if the trademark registrant applies for renewal and is approved, the exclusive right to use the trademark continues to exist, and others use the same or similar trademark during this period, which is a trademark infringement;
(2) If the trademark registrant fails to apply for renewal, or the application for renewal is not approved, the exclusive right to use the trademark is not protected by law after the expiration of the validity period, so it is not trademark infringement for others to use the same or similar trademark during this period;
(3) Where a trademark is requested to be protected during the extension period, the complainant shall provide proof of applying for renewal; Otherwise, the administrative department for industry and commerce shall not file a case; If a case has been put on file, it shall be suspended, and it shall be handled after the extension is confirmed.
