Article 5: An enterprise has the following circumstances: 1. The administrative departments for industry and commerce at or above the county level shall include the list of enterprises with serious violations of laws and untrustworthiness for management:

(1) Those who have been included in the list of companies with abnormal operations and have not performed relevant obligations for three years;

(2) Submit false materials or use other fraudulent means to conceal important facts, obtain company changes or cancel registration, and have the registration revoked;

(3) Organize and plan pyramid schemes, or provide information due to pyramid schemes Convenient conditions subject to administrative penalties more than three times within two years;

(4) Administrative penalties imposed more than three times within two years due to direct selling violations;

(5) Unfair competition twice Subject to administrative penalties more than three times within the year;

(6) Subject to three administrative penalties within two years because the goods or services provided do not meet the requirements for protecting personal and property safety, causing personal injury and other illegal acts that seriously infringe the rights and interests of consumers.

(7) Subject to administrative penalties more than three times within two years for publishing false advertisements, or publishing false advertisements for goods or services that are related to the life and health of consumers, resulting in personal injury or other serious Having a negative impact on society;

(8) Being subject to more than two administrative penalties within five years due to trademark infringement;

(9) Being decided to stop accepting trademark agency business;

(10) Other violations of industrial and commercial administrative laws and administrative regulations as prescribed by the State Administration for Industry and Commerce and the circumstances are serious.

If an enterprise violates industrial and commercial administrative laws and administrative regulations, commits any of the acts specified in items (3) to (8) of the preceding paragraph, and is subject to administrative penalties three or more times within two years, it shall be classified as a serious violation of law. Article 13: The industrial and commercial administrative departments at all levels shall implement the following management on enterprises included in the list of serious illegal and untrustworthy enterprises:

(1) Listed as key supervision and management objects;

(2) The legal representative and responsible person of an enterprise that is included in the list of seriously illegal and untrustworthy enterprises in accordance with the provisions of Article 5, Paragraph 1, Item (1) of these Measures shall not serve as the legal representative or responsible person of other enterprises within 3 years. (3) Not passing the qualification review for the “Abide by Contracts and Valuing Credit” enterprise publicity activities;

(4) Not being awarded relevant honorary titles.

Article 14 The industrial and commercial administrative department shall record the information included in the list of enterprises with serious violations of laws and untrustworthiness in the public information of the enterprise, and make it uniformly public through the enterprise credit information publicity system.

The industrial and commercial administrative departments should share the list information of serious illegal and untrustworthy enterprises with other government departments to implement joint punishment.
