How to apply for trademark review

Legal analysis: If a trademark registration applicant is dissatisfied with the Trademark Office’s decision to reject the application or not publish the application, he or she may apply to the Trademark Review and Adjudication Board for review. The Trademark Review and Adjudication Board will make a decision within 9 months from the date of receipt of the application and notify the applicant in writing. The trademark review process is as follows: 1. A copy of the enterprise's legal person business license (with official seal); 2. The conception and use of the trademark (mainly highlighting the popularity); 3. Company profile; 4. Various honors obtained by the enterprise; 5. Enterprise Sales, advertising expenses and related financial conditions in the past three years; 6. Original and copy of corporate media reports or picture advertisements; 7. Original and copy of the appearance of the company's products sold; 8. Other evidence and materials that can prove the company's popularity; 9. Proof of the earliest use of this trademark; 10. The applicant needs to sort out the material evidence provided and stamp it with the official seal.

Legal basis: Article 34 of the "Trademark Law of the People's Republic of China" For a trademark that rejects the application and refuses to be announced, the Trademark Office shall notify the trademark registration applicant in writing. If the trademark registration applicant is dissatisfied, he may apply to the Trademark Review and Adjudication Board for review within fifteen days from the date of receipt of the notice. The Trademark Review and Adjudication Board shall make a decision within nine months from the date of receipt of the application and notify the applicant in writing. If there are special circumstances that require an extension, it can be extended for three months with the approval of the industrial and commercial administration department of the State Council. If the party concerned is dissatisfied with the decision of the Trademark Review and Adjudication Board, it may file a lawsuit with the People's Court within thirty days from the date of receipt of the notice.
