Article 9 of China's Trademark Law stipulates: "A trademark applied for registration shall have distinctive features, be easy to identify, and shall not conflict with the prior rights of others". The distinctive features of a trademark refer to its uniqueness and identifiability. No matter what form a trademark is made up of, it should be as novel and unique as possible to distinguish it from other similar goods.
Second, trademarks should be registered in different categories, so you might as well register more.
There are 45 categories of trademarks, and registered trademarks should be applied in different categories. When you apply, you must indicate which category you want to register. The law only protects which category you apply for registration.
Third, trademarks should consider regional characteristics.
The exclusive right to use a trademark is regional, and a trademark approved for registration in a certain country or region is only valid in that country or region and protected by laws in that region. However, in today's highly developed transportation and information and increasingly frequent international exchanges, the global market tends to be unified, and economic opening and world trade liberalization have become an irreversible trend. Enterprises should have a strategic vision when creating trademarks, so that the created trademarks are conducive to the development of enterprises to the international market and to establishing their own product reputation and entrepreneurial spirit in the international market. Therefore, enterprises should apply to other countries for registered trademarks or international registration of trademarks in a timely manner according to the sales of their own goods.
