1, knowingly holding and transporting a forged credit card;
2, knowing that it is a forged blank credit card and holding and transporting it for more than ten times;
3. Illegally holding another person's credit card for more than five times;
4. Use false identification to defraud credit cards;
5. Selling, buying or providing others with forged credit cards or obtaining credit cards by fraudulent means;
6. Whoever applies for a credit card against others' wishes by using identity cards, military officer's cards, soldier's cards, Hong Kong and Macao residents' passes to and from the mainland, mainland travel permit for taiwan residents, passports, etc., or applies for a credit card by using forged or altered identity certificates, shall be identified as "using false identity certificates to defraud a credit card".
Legal basis: Article 177-1 of the Criminal Law of People's Republic of China (PRC) has one of the following circumstances, which hinders the management of credit cards, and shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also be fined not less than 10,000 yuan but not more than 100,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan: (1) Holding and transporting a large number of credit cards knowing that they are forged, or holding and transporting them knowing that they are blank credit cards; (2) Illegally holding other people's credit cards, with a relatively large number; (3) using false identification to defraud credit cards; (4) Selling, purchasing or providing others with forged credit cards or obtaining credit cards by fraudulent means.
Article 2 of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Impairment of Credit Card Management (revised 20 18) shall be deemed as "a large number" as stipulated in Item 1, Paragraph 1, Article 177 of the Criminal Law; Those who illegally hold more than five credit cards but less than fifty shall be deemed as "a large number" as stipulated in Item 2, Paragraph 1, Article 177-1 of the Criminal Law.
In any of the following circumstances, it shall be deemed as "a huge quantity" as stipulated in the first paragraph of Article 177-1 of the Criminal Law: (1) Holding and transporting more than ten credit cards knowing that they are forged; (2) knowingly holding or transporting more than 100 blank credit cards; (3) illegally holding more than 50 credit cards of others; (four) using false identification to defraud more than ten credit cards; (5) Selling, purchasing or providing others with forged credit cards or obtaining more than ten credit cards by fraudulent means.
Applying for a credit card against the wishes of others by using my ID card, military officer's card, soldier's card, Hong Kong and Macao residents' travel permit to and from the mainland, mainland travel permit for taiwan residents, passport, etc. Or using forged or altered identification to apply for a credit card, it shall be deemed as "using false identification to defraud a credit card" as stipulated in Item 3, Paragraph 1, Article 177-1 of the Criminal Law.
