You can file for divorce if you owe credit card money. If both spouses voluntarily divorce, they should sign a written divorce agreement and apply for divorce registration in person at the marriage registration authority. Within thirty days from the date the marriage registration authority receives the divorce registration application, if either party is unwilling to divorce, they may withdraw the divorce registration application from the marriage registration authority.

According to Article 1076 of the "People's Republic of China and the Civil Code" that came into effect on January 1, 2021

If both spouses voluntarily divorce, they must sign a written divorce agreement and apply for divorce registration in person at the marriage registration authority.

The divorce agreement should state the intention of both parties to divorce voluntarily and the consensus on matters such as child support, property and debt settlement.

Article 1077

If either party is unwilling to divorce within thirty days from the date when the marriage registration authority receives the application for divorce registration, he or she may apply to the marriage registration authority for divorce. Withdraw the application for divorce registration.

Within thirty days after the expiration of the time limit specified in the preceding paragraph, both parties shall apply in person to the marriage registration authority for issuance of a divorce certificate; failure to apply shall be deemed to have withdrawn the application for divorce registration.
