Legal analysis: 1. Lending a credit card to others for cash, and returning it on time if the amount is small, is just a violation of the agreement for the bank and belongs to the civil category. 2. If you can't return it on time, it will affect your credit and generate high interest. This malicious overdraft reaches a certain level, and criminal responsibility can also be investigated. If the credit card is overdrawn in bad faith for more than 1, yuan, and the cardholder takes illegal possession as the purpose, and fails to return it for more than 3 months after being collected twice by the issuing bank, criminal responsibility shall be investigated for the crime of credit card fraud.

the malicious overdraft mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.
whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of article 264 of this law.
