The amount of credit card fraud is 80,000 yuan. How many years will you be sentenced after the stolen money is returned? How much fine will you have to pay?

Credit card fraud involving an amount of RMB 80,000 is considered a relatively large amount and should normally be punished with imprisonment of not more than five years or criminal detention, and a fine of not less than RMB 20,000 but not more than RMB 200,000. As long as the crime of fraud constitutes a crime, returning the stolen goods and not returning the stolen goods are the same, both constitute a crime, but returning the stolen goods will be of great help in sentencing. The specific sentence depends on the court. The court's decision will also be based on the offender's criminal circumstances, repentance, return of stolen goods, etc.

Article 196 of the "Criminal Law": Whoever commits credit card fraud activities under any of the following circumstances and the amount is relatively large shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan and not less than 20 yuan. (1) Using a forged credit card, or using a credit card fraudulently obtained with false identity certificates

(2) Using an expired credit card;

(3) Pretending to use another person’s credit card;
