Is it illegal to have your credit card frozen by law?

It is not necessarily a crime for a credit card to be frozen by law. Being judicially frozen may be due to the refusal to perform the obligations stipulated in the effective judgment, and an application for compulsory execution is made. If the circumstances are not serious, it will not constitute the crime of refusal to perform the judgment or ruling, and it is not a crime. If the crime is frozen due to criminal suspicion and the facts of the crime are clear after investigation by the public security organ, it is a crime.

The property that cannot be judicially frozen is as follows:

1. Clothes, furniture, cooking utensils, tableware and other items necessary for family life for the person subject to execution and his dependent family members. ;

2. Necessary living expenses for the person subject to execution and his dependent family members. If there is a local minimum living security standard, the necessary living expenses shall be determined according to this standard;

3. Items necessary for the person subject to execution and his dependent family members to complete compulsory education;

4 , Undisclosed inventions or unpublished works;

5. Auxiliary tools and medical items necessary for the person subject to execution and his dependent family members to deal with physical defects;

6. Medals and other items of honor and recognition received by the person subject to execution.

Article 249

If the person subject to execution fails to perform the obligations specified in the legal document in accordance with the execution notice, the people's court has the right to inquire the relevant units about the deposits, bonds, stocks, fund shares and other property of the person subject to execution. The People's Court has the power to seize, freeze, transfer, and change the value of the property of the person subject to execution based on different circumstances. The property inquired, seized, frozen, transferred, and valuated by the People's Court shall not exceed the scope of the obligations that the person subject to execution shall perform.

When the people's court decides to seize, freeze, transfer or change property, it shall make a ruling and issue a notice of assistance in execution, and the relevant units must handle it.
