After the relief fund management institution advances the rescue expenses and funeral expenses, it may claim compensation from the responsible party of the road traffic accident according to law. The relief fund management institution may, according to the responsibilities specified in the accident confirmation, issue a Notice on Repaying the Advance Expenses of Social Relief Fund for Road Traffic Accidents to the relevant compensation obligors within 10 working days, requiring them to directly repay the expenses paid by the relief fund management institution, and specify the repayment period and amount. Rescue expenses and funeral expenses that are really irrecoverable may be written off. The circumstances that allow the advance payment to be written off include: the compensation obligor is declared bankrupt, closed, dissolved or revoked according to law, or its business license is cancelled or revoked according to law, and its liquidation property is insufficient to pay off; The compensation obligor dies or is declared missing or dead according to law, and his property or inheritance is insufficient to pay off; The compensation obligor has not paid off his debts for more than 3 years, and there is conclusive evidence to prove that he has been unable to pay off his debts; The case of hit-and-run traffic accident has not been detected within 3 years from the date of the crime; Unable to recover due to force majeure such as natural disasters; Other conditions stipulated by the competent department of provincial relief funds.
