Retired public officials who commit illegal acts before or after retirement shall not be given administrative sanctions, but may be investigated; Those who should be punished by demotion, dismissal or dismissal according to law shall be dealt with accordingly, and illegally obtained property and personal property used for illegal acts shall be dealt with according to the provisions of Article 25 of this Law.

If a public official leaves his post or dies and commits an illegal act during the performance of his duties, it shall be handled in accordance with the provisions of the preceding paragraph.

How to calculate pension after serving a sentence

1. If an employee is sentenced or reeducation through labor, his personal account shall be kept by the social insurance agency during the period of serving his sentence or reeducation through labor, and interest shall continue to be calculated at the bookkeeping rate; After reaching the statutory retirement age, the personal account amount will bear interest according to the bank's savings deposit rate for urban and rural residents in the same period;

For enterprise employees who have paid 15 years before being sentenced, for government agencies and institutions, middle-aged people pay 10 years, and newcomers pay 15 years, they can go through retirement procedures and receive basic pensions on a monthly basis;

If an employee is sentenced or released from prison after reeducation through labor and exceeds the statutory retirement age, but the accumulated payment period of the individual is less than 15 years, he cannot go through the retirement formalities normally, and all the deposits in his personal account are paid to him in one lump sum to terminate the basic old-age insurance relationship;

4. Employees who are already retired and receive normal pensions, who are sentenced or re-educated after retirement, do not enjoy the basic old-age insurance benefits during the period of serving their sentences and re-education, and stop issuing basic pensions. The basic pension after the political rights are restored after the release of a sentence or the expiration of reeducation through labor is paid according to the standards before serving the sentence and reeducation through labor, that is to say, even if the pension increases greatly during serving the sentence, the pension of the prisoner will not increase with it, but will be paid according to the standards before serving the sentence;

5. Retirees who are sentenced to criminal detention or fixed-term imprisonment with a suspended execution can enjoy basic pension benefits during criminal detention or probation, but do not participate in the adjustment of basic pension;

7. If a retiree dies during serving his sentence or reeducation through labor, the principal and interest of the balance of individual contributions in his personal account can be inherited, but the survivors do not enjoy other corresponding treatment;

8. During the period when retirees are wanted for suspected crimes or detained without conviction, the basic pension will be suspended. If the court finds him innocent, the wanted order or the basic pension during detention will be reissued.
