How long does it take to renew the trademark?
There is no statutory time limit for the examination of trademark renewal applications in China. According to experience, it takes about four months from the application for renewal to the announcement. The processing speed is related to the applicant's region, because the examiner who changed the renewal office manages the documents according to the region. After the transfer, renewal and change are successful, the transfer approval certificate, renewal approval certificate or change notice will be issued, and no new trademark registration certificate will be issued. These certificates or notices need to be used together with the original registration certificate. The renewal of a registered trademark means that the owner of the registered trademark goes through the formalities according to law to extend the validity of the trademark. The term of validity of a registered trademark refers to the period during which the trademark has legal effect, also known as the term of exclusive right. China's current trademark law follows international practice and uniformly stipulates the validity period of the exclusive right to use trademarks of domestic and foreign registrants. The period of validity of a registered trademark is 10 years, counting from the date of approval of registration. Where a trademark owner applies for renewal of registration, he shall apply within 6 months before the expiration of the registered trademark. If the application is not made within the prescribed time limit, an extension of six months may be given (that is, within six months after the expiration of the validity period), but the overdue fine shall be paid according to the regulations. If no application for renewal of registration is filed within the grace period, the Trademark Office will revoke its registered trademark and make an announcement. According to the provisions of the Trademark Law and its detailed rules for implementation, the owner of a registered trademark shall go through the registration renewal application formalities with the Trademark Office, fill in the Trademark Renewal Application Form, return the original Trademark Registration Certificate, and attach five trademark designs. The Trademark Office shall approve the application with complete procedures and compliance with the law, return the original Trademark Registration Certificate, add notes and make an announcement. Obviously violating the existing trademark law or relevant provisions, the application shall not be approved and rejected. If the applicant refuses to accept the rejection of the application for renewal of registration by the Trademark Office, he shall apply to the Trademark Review and Adjudication Board for reexamination within 15 days after receiving the notice of rejection, and the Trademark Review and Adjudication Board shall make a final decision. Because of our national standard, the ownership of bidding is only ten years. Therefore, according to national laws and regulations, it is necessary to go to the Trademark Office for renewal one year before the expiration of ten years. The renewal is about four to six months. If it is not renewed within the renewal period, it can be renewed within a six-month extension period after the expiration.
