In order to standardize bidding activities, protect national interests, social interests and the legitimate rights and interests of the parties involved in bidding activities, improve economic benefits and ensure project quality. Taking performance as the scoring item, the scoring clauses with unclear certification requirements are: "provide certain performance and provide relevant certification materials" or "provide certain performance and provide relevant certification materials such as bid-winning notice". According to the characteristics of the project, the procurement documents should specify the name of the required performance certification materials. The performance of goods and services shall be based on the bid-winning (transaction) notice and contract, and a performance acceptance report may be required when necessary; Under special circumstances, the valid purchase (purchase, sale or service) contract signed by Party A and Party B can also be used as proof materials. For engineering projects, the completion acceptance report is required. The procurement documents should also specify the time range in which the certification materials should reflect the performance requirements, the name or details of the products (or similar products), the contents of the project services, the names of the purchasers and suppliers (official seals are clearly visible), etc. If there are requirements for the project manager or team, the name and team list of the project manager should be reflected. However, it should be noted that the specific performance amount is not suitable as a scoring item. The contract amount is related to operating income, and setting contract performance conditions for a specific amount constitutes differential or discriminatory treatment for small and medium-sized enterprises.

A tenderer who commits one of the following acts shall restrict or exclude potential bidders or bidders with unreasonable conditions:

(1) Providing different project information to potential bidders or bidders of the same project subject to tender;

(2) The qualification, technology and business conditions set are not suitable for the specific characteristics and actual needs of the project subject to tender or have nothing to do with the performance of the contract;

(4) adopting different qualification examination or evaluation criteria for potential bidders or bidders;

(5) Restricting or designating specific patents, trademarks, brands, countries of origin or suppliers.

(six) the project that must be subject to tender according to law illegally restricts the ownership or organizational form of potential bidders or bidders;

(seven) to restrict or exclude potential bidders or bidders by other unreasonable conditions.
