According to the provisions of Article 38 of China's Trademark Law, if a registered trademark needs to continue to be used after its expiration, it shall apply for renewal of registration six months before its expiration. If the application cannot be submitted within this period, a grace period of six months can be given. If no application is filed within the grace period, its registered trademark shall be cancelled.

Grace period is not a period that every registered trademark must go through. There is no grace period for a registered trademark that applies for renewal six months before the expiration of its validity period. Only registered trademarks that Xu Zhan has not applied for before the expiration of the validity period can be renewed. The extension period is connected with the validity period of the registered trademark, followed by it. If no application for trademark renewal is filed within the grace period, the Trademark Office will cancel its registered trademark after a grace period of six months.

In other words, the extension period of trademark registration is a specific period of 6 months after the expiration of the registered trademark that has not applied for renewal of registration. Its starting point is the day after the expiration of the registered trademark, and the end point is the day after the expiration of six months.

In addition, during the grace period, only the owner of a registered trademark can apply to the Trademark Office for renewal of the trademark, and no one else can register a trademark that is the same as or similar to the trademark, that is, the opportunity to obtain the exclusive right to use a registered trademark belongs exclusively to the owner of the original registered trademark.

The essence of the grace period is to legally extend the protection of the trademark renewal right of the original registered trademark owner and extend the protection of the trademark renewal right of the original registered trademark owner for six months.
