How to go to the process of trademark invalidation
If a registered trademark violates the provisions of Articles 1, 11 and 12 of the Trademark Law, or is registered by deception or other improper means, the Trademark Office shall declare the registered trademark invalid; Other units or individuals may request the Trademark Review and Adjudication Board to declare the registered trademark invalid.

The application process for invalidation is as follows:

1. Prepare the application for invalidation

The documents required for the application for invalidation should be put in the following order and bound in duplicate.

(1) application for invalidation of a registered trademark (home page);

(2) List of review materials;

(3) an application for invalidation of a registered trademark (text);

(4) Copies of the announcement page for preliminary examination and approval of disputes and the registration announcement page;

(5) power of attorney for trademark agency (power of attorney with signature if entrusted to a trademark agency);

(6) the applicant's qualification documents;

(7) evidence catalogue and evidence materials.

2. Submit the application for invalidation to the Trademark Office

3. The Trademark Office accepts and examines

After formal examination, it will issue an acceptance notice to the application for invalidation that meets the acceptance conditions, and notify the respondent of invalidation to reply. There is an evidence exchange procedure in the process of invalidation, and both parties check each other's reasons and evidence.

4. The Trademark Office makes a ruling

on intellectual property rights.
