The Madrid trademark registration process is as follows:
(1) Submit the application to the official website
Submit the application to the International Office of the China Trademark Office.
(2) The International Office will conduct a formal review
The International Office will conduct a formal review to see if it meets the application requirements: trademark, product, application basis, fee payment, etc.
(3) The International Office issues an acceptance notice
If the formal review is passed, the International Office will issue an acceptance notice, which generally takes 3 to 6 months.
(4) The International Bureau conducts formal examination
After the International Office passes the formal examination, the application is submitted to the International Bureau for formal examination.
(5) The International Bureau issues a certificate of international trademark registration
The International Bureau passes the formal examination and issues a certificate of international trademark registration (effective as a domestic acceptance notice). The date of application will be approximately About 6~9 months.
(6) Examination by the trademark authorities of each country designated for protection
The International Bureau will transfer the application to the country designated for protection, and the trademark authorities of each country will review it in accordance with the laws of the country.
(7) Approval/rejection of protection by each designated country
The countries designated for protection when applying for international trademark registration decide whether to grant protection according to their respective national laws. It will take about 18 years from the date of application. -Around 24 months.
It should be noted that at present, a considerable number of countries will not issue any documents after the Madrid registration is completed. Applicants can check the registration results according to the records on the International Bureau website. It should also be noted that the review period is 12 months for members of the Agreement and 16 months for members of the Protocol, but rejections based on objections may exceed 18 months.
