Is it illegal for online stores to transfer trademarks?
It can be divided into two situations: trademark registrant turns trademark and others turn trademark. If the trademark registrant only changes the overall form of expression, but not the specific elements of the trademark, it is not illegal. Where a major change is made to a trademark, it is necessary to correct or cancel the trademark within a time limit. If someone else uses the trademark, it is illegal and needs to bear tort liability.

legal ground

Article 52 of the Trademark Law of People's Republic of China (PRC) uses an unregistered trademark as a registered trademark, or uses an unregistered trademark in violation of the provisions of Article 10 of this Law, the local administrative department for industry and commerce shall stop it, make corrections within a time limit, and may notify it. If the illegal business amount is more than 50,000 yuan, a fine of less than 20% of the illegal business amount may be imposed; if there is no illegal business amount or the illegal business amount is less than 50,000 yuan, a fine of less than 1 10,000 yuan may be imposed.
