the judgment of overdue credit card prosecution will generally be executed within six months. According to the relevant laws of our country, court enforcement usually ends within 6 months after the effective judgment, but the period of suspension of execution should be deducted. If there are special circumstances that need to be extended, it shall be approved by the president of our hospital. The court will adopt various methods to execute the property of the respondent, such as inquiring, freezing and allocating the deposit of the respondent. Seal up, detain, auction or sell off the property of the person against whom the application is made. You can apply for enforcement within two years after the judgment takes effect. Once you enter the enforcement procedure, there is no time limit! The court will use many methods, such as sealing up accounts, sealing up real estate and other means to complete the implementation. The longest period for freezing the deposit of the person who is applied for execution is six months. If it is necessary to continue to freeze, the freezing procedures shall be handled at the bank, credit cooperative, etc. before the expiration of the freezing period. Otherwise, if it is not handled within the time limit, it will be regarded as automatic unfreezing. Here, I would like to remind everyone that the application for compulsory execution must be made within two years after the judgment takes effect. If the time limit exceeds two years, compulsory execution cannot be forced. The court's means of compulsory execution is the last resort, and it needs to bear the risks brought by the execution error. If there is any objection to the court's judgment, you can appeal first. If you find that your credit card is overdue and you can't handle the arrears in a short time, the most effective way is to keep the phone open, don't lose contact, and express your willingness to repay to the bank. It is best to reach a negotiated installment repayment plan. Only in this way can the risk of collection and prosecution be avoided. And the policy stipulates that the arrears can be divided into up to 6 installments without interest.
Legal basis
Article 226 of the Civil Procedure Law of the People's Republic of China (revised in 217) applies to a higher court for execution. If the people's court fails to execute it for more than six months from the date of receiving the application for execution, the applicant executor may apply to the people's court at the next higher level for execution. After examination, the people's court at the next higher level may order the original people's court to execute it within a certain period of time, or it may decide to execute it by itself or instruct other people's courts to execute it.
