Article 196 of the Credit Card Criminal Law

Article 196 of the Criminal Law stipulates the crime of credit card fraud, which stipulates that those who conduct credit card fraud activities with relatively large amounts are generally punishable by fixed-term imprisonment of not more than five years or criminal detention, and a fine of 20,000 to 200,000 yuan. Relevant laws and regulations also include the "Regulations on the Standards for Filing and Prosecution of Criminal Cases under the Jurisdiction of Public Security Organs (2)".

Legal basis

Article 196, paragraph 1, item 4 of the "Criminal Law of the People's Republic of China"

Under the following circumstances 1. Whoever commits credit card fraud and the amount is relatively large shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; if the amount is huge or there are other serious circumstances, he shall be sentenced to not less than five years but not more than 10 years. If the amount is particularly huge or there are other particularly serious circumstances, the sentence shall be fixed-term imprisonment of not less than 10 years or life imprisonment and a fine of not less than 50,000 yuan but not more than 500,000 yuan, or Confiscation of property:

(4) Malicious overdraft.
