Civil servants who commit the above acts will be punished as follows according to the Civil Service Law:
Civil servants can't do business, even if they work part-time in for-profit organizations.
Article 53 of the Civil Service Law: "Civil servants must abide by discipline and shall not commit any of the following acts:
(14) engaging in or participating in profit-making activities and taking part-time jobs in enterprises or other profit-making organizations ".
Nothing more than: Article 5 of the "Several Guidelines for Leading Cadres of China * * * Production Party party member (Trial)": Leading cadres in party member should abide by the law in matters involving spouses, children, other relatives and friends and staff around them. It is forbidden to use authority and position influence to seek benefits for relatives, friends and staff around. The following behaviors are not allowed:
(1) Asking or instructing spouses, children, other relatives and friends and their staff to be promoted;
(two) using public funds to pay for the study and training expenses of spouses, children and other relatives and friends;
(three) to ask individuals or organizations outside the country (territory) for financial assistance for spouses, children and other relatives and friends to travel abroad, visit relatives and study abroad;
(four) hinder the investigation and handling of cases involving spouses, children, other relatives and friends and staff around them;
(five) to provide convenience and preferential conditions for spouses, children and other relatives and friends to do business and run enterprises.
The spouses, children and their spouses of leading cadres at or above the provincial (ministerial) level shall not work in enterprises run by individuals or wholly foreign-owned enterprises within the areas and business scope under the jurisdiction of the leading cadres.
2. Legal consequences
Article 27 of the Civil Service Law stipulates: "Those who engage in or participate in profit-making activities and hold concurrent positions in enterprises or other profit-making organizations shall be given demerits or gross demerits; If the circumstances are serious, demotion or dismissal shall be given; If the circumstances are serious, dismissal will be given. " This is an administrative responsibility and does not require sentencing.
Constitute a criminal offence. Which means you'll be sentenced. In official activities, state functionaries take advantage of their positions to seek benefits for customers, buy and sell customers' houses and vehicles at prices obviously lower than or higher than the market, or illegally accept customers' property or shares by other trading methods, or "cooperate" with customers to start a company or make other "cooperative" investments, or in the name of entrusting customers to invest in securities, futures or other entrusted wealth management, but they have no actual investment, or get "income" because of it.
