Regulations of Guangdong Province on Unemployment Insurance
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Labor Law of People's Republic of China (PRC) and relevant laws and regulations, and in combination with the actual situation of this province, in order to ensure the basic livelihood of workers during unemployment and promote their re-employment. Article 2 These Regulations shall apply to unemployment insurance within the administrative area of this province.

Enterprises, organs, institutions, social organizations, private non-enterprise units, urban individual economic organizations (hereinafter referred to as units) and workers who have formed labor relations with them (hereinafter referred to as employees) within the administrative region of this province shall participate in unemployment insurance in accordance with these regulations.

Unemployment insurance for national civil servants and employees managed by reference and in accordance with the national civil service system shall be implemented in accordance with state regulations. Article 3 People's governments at all levels shall guarantee the raising of unemployment insurance funds and the payment of unemployment insurance benefits according to law.

The unemployment insurance fund and unemployment insurance benefits shall be exempted from taxes and fees in accordance with state regulations. Article 4 The administrative department of labor security of the provincial people's government is in charge of unemployment insurance in the whole province and is responsible for organizing the implementation of these Regulations.

The administrative department of labor security of the people's government of the city or county (District) shall be in charge of the unemployment insurance work within its administrative area.

Social insurance agencies shall undertake unemployment insurance in accordance with the provisions of the state and the province.

The relevant administrative departments of the people's governments at all levels and trade unions and other organizations shall, in accordance with their respective responsibilities, cooperate with the administrative departments of labor security to do a good job in unemployment insurance. Article 5 Unemployment insurance shall be subject to territorial management. The unemployment insurance fund shall be co-ordinated by the whole city (above the prefecture level, the same below). The provincial people's government can decide to implement the overall planning of the province according to the actual situation.

Units and their branches shall participate in unemployment insurance at the place of registration. Chapter II Unemployment Insurance Fund Article 6 The unemployment insurance fund consists of the following items:

(1) Unemployment insurance premiums paid by units and employees;

(2) Interest of the unemployment insurance fund;

(3) Late payment fees for unemployment insurance premiums;

(4) financial subsidies;

(five) other funds that should be included in the unemployment insurance fund according to law. Seventh units shall pay unemployment insurance premiums according to 2% of the total wages of employees (including farmers' contract workers) who should participate in unemployment insurance; Workers pay unemployment insurance premium according to 1% of their salary, among which farmers' contract workers do not pay unemployment insurance premium. Article 8 Unemployment insurance premiums shall be collected by local tax authorities, and no unit may refuse to pay them. Unemployment insurance premiums shall be paid in full in the form of money and shall not be reduced or exempted. The local tax authorities shall provide the social insurance agencies with the payment information of the payment units and employees in a timely manner; Social insurance agencies shall collect relevant information in a timely manner and report to the administrative department of labor security.

The unemployment insurance premium paid by the unit and its interest or late payment fee shall be implemented in accordance with the relevant provisions of the state. The unemployment insurance premium paid by employees shall be withheld and remitted from their wages by their units before individual income tax is levied. Article 9 If a unit is really unable to pay unemployment insurance premiums on time, it may apply to the local tax authorities for deferred payment and provide property mortgage. Upon approval, the maximum deferred payment period shall not exceed six months. After the expiration of the holdover period, the unit and its employees shall pay the principal and interest of the holdover unemployment insurance premium, and shall be exempted from the late payment fee. The interest paid is calculated according to the bank deposit rate of urban and rural residents in the same period, which shall be borne by the unit and shall not be passed on to individual employees. If the deferred payment fails to be paid according to the provisions after the expiration of the period, the local tax authorities may auction or sell the collateral to offset the payment, or apply to the people's court for compulsory execution. Article 10 Where a unit is terminated due to bankruptcy, dissolution or other reasons, the liquidator or unit shall notify the local tax authorities and social insurance agencies where the unit is located to pay off unemployment insurance premiums and their interest or late fees in the order of wages.

Units after division or merger (merger) shall enjoy and bear the unemployment insurance rights and obligations of the original units. Eleventh unemployment insurance fund for the following expenses:

(1) unemployment insurance benefits;

(two) medical subsidies for the unemployed during the period of receiving unemployment insurance benefits;

(3) Funeral grants for the unemployed who died during the period of receiving unemployment insurance benefits and pensions for their dependent spouses and immediate family members;

(four) the unemployed receive subsidies for vocational training and job introduction during the period of receiving unemployment insurance benefits;

(five) other expenses related to unemployment insurance stipulated or approved by the State Council. Twelfth unemployment insurance funds must be deposited in the financial accounts of social security funds opened by the financial department in state-owned commercial banks, and the management of two lines of revenue and expenditure shall be implemented, and the financial department shall supervise them according to law.

The unemployment insurance fund is earmarked for special purposes and shall not be used for other purposes, and shall not be used to balance fiscal revenue and expenditure.

Local tax authorities and social insurance agencies shall not withdraw any expenses from the unemployment insurance fund, and the required funds shall be included in the budget and allocated by the finance. Thirteenth before the overall implementation of the province, the municipalities shall pay the adjustment fund to the province in accordance with the proportion of the total amount of unemployment insurance funds collected in that year. When the proportion of transferred funds needs to be adjusted, it shall be stipulated by the provincial people's government.

When the adjustment funds turned over by cities and unemployment insurance funds are insufficient, they shall be adjusted by provincial adjustment funds and subsidized by local finance. Chapter III unemployment insurance benefits Article 14 Unemployed persons who meet the following conditions may receive unemployment insurance benefits and enjoy other unemployment insurance benefits in accordance with regulations:

(a) according to the provisions to participate in unemployment insurance, the unit and I have fulfilled the obligation to pay for one year or less, but I still have the time limit to receive unemployment insurance benefits;

(two) the employment is not interrupted because of my will;

(three) in accordance with the provisions of the unemployment insurance procedures, and there are job requirements.
